These Terms of Service (“Terms”) govern your access to and use of kathrynfinney.com (the “Site”), and any products, services, content, newsletters, downloads, or programs offered by Genius Guild LLC (“Genius Guild,” “we,” “us,” or “our”), including BUILD Sprint, the Build the Damn Thing newsletter, The Receipts newsletter, and related offerings (collectively, the “Services”). By accessing or using the Site or any Services, you agree to these Terms. If you do not agree, please do not use the Site or the Services.
1.Who We Are
Genius Guild LLC is a Delaware limited liability company. The Site and the Services are operated by Genius Guild on behalf of Kathryn Finney and the Genius Guild brand family, including Build the Damn Thing and BUILD.

2.Eligibility
You must be at least 18 years old to purchase any paid Services or enter into a contract with us. By using the Site, you represent that you meet this requirement and that you have the legal authority to agree to these Terms. The Site is not intended for use by anyone under 13.
3.Your Account and Subscriptions
Some Services, including newsletter subscriptions and BUILD Sprint, may require you to provide an email address or other information. You agree to provide accurate and current information and to keep it updated. You are responsible for safeguarding any credentials associated with your access and for activity that occurs under your email or account.
4.Purchases and Payments
Paid Services, including BUILD Sprint, are sold at the price displayed at the time of purchase. Prices are in U.S. dollars unless stated otherwise. Payments are processed by Stripe, Inc. By making a purchase, you authorize us and Stripe to charge your payment method for the amount shown at checkout, plus any applicable taxes.
You are responsible for keeping your payment information accurate. If a charge is declined, we may suspend access to the paid Service until payment is resolved.
5.Refund Policy
Because BUILD Sprint and similar digital Services deliver immediate access to proprietary tools, frameworks, and outputs, all sales are final and non-refundable unless otherwise required by law or stated in writing at the time of purchase. If you believe you were charged in error or experienced a technical issue that prevented you from receiving the Service, contact support@buildthedamnthing.com within seven (7) days of purchase and we will review your request in good faith.
6.Newsletters and Email Communications
By subscribing to a newsletter, you consent to receive emails from us, including The Receipts and Build the Damn Thing newsletters. You can unsubscribe at any time using the link in any newsletter email. Even after unsubscribing, you may still receive transactional or service-related emails.
7.Intellectual Property
All content on the Site and within the Services, including essays, infographics, frameworks, tools, templates, downloads, video, audio, images, course materials, and the Build the Damn Thing methodology, is owned by Genius Guild LLC, Kathryn Finney, or our licensors and is protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and the Services for your personal, non-commercial use. For paid Services such as BUILD Sprint, this license extends to your own business use of the outputs you generate through the Service.
You may not:
- Copy, reproduce, distribute, publish, display, or create derivative works from our content without our written permission
- Resell, sublicense, or redistribute access to any paid Service
- Use our content to train, fine-tune, or develop any artificial intelligence model or machine learning system
- Remove or alter any copyright, trademark, or other proprietary notices
- Use our trademarks, name, or likeness without our written permission
8.User Content and Conduct
If you submit comments, questions, replies, testimonials, or other content to us or through the Services (“User Content”), you grant Genius Guild a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, publish, and display that User Content in connection with operating and promoting the Site and the Services. You represent that you own or have the rights to submit any User Content you provide.
You agree not to:
- Use the Site or Services for any unlawful purpose
- Harass, threaten, defame, or harm any other person
- Submit content that is false, misleading, defamatory, obscene, or infringing
- Attempt to gain unauthorized access to the Site, our systems, or other users’ accounts
- Interfere with, disrupt, or attack the Site or its security features
- Scrape, crawl, or use automated tools to extract data from the Site without our written permission
9.Third-Party Links and Services
The Site may contain links to third-party sites and services, including Amazon, Penguin Random House, Substack, LinkedIn, Instagram, and Stripe. We do not control these third parties and are not responsible for their content, products, or practices. Your use of third-party services is governed by their own terms and policies.
10.Disclaimers
The Site, the Services, and all content provided through them are offered on an “as is” and “as available” basis, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
The information, frameworks, tools, and content we provide are for educational and informational purposes only. They are not legal, financial, tax, investment, medical, or professional advice. Your business outcomes depend on many factors outside our control, including your effort, market conditions, and individual circumstances. We do not guarantee any specific result, revenue, growth, or business outcome from using BUILD Sprint, our newsletters, our books, or any other Service.
11.Limitation of Liability
To the fullest extent permitted by law, Genius Guild LLC, Kathryn Finney, and our affiliates, officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Site or the Services, even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or related to these Terms, the Site, or the Services will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
12.Indemnification
You agree to defend, indemnify, and hold harmless Genius Guild LLC, Kathryn Finney, and our affiliates, officers, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or the Services, your User Content, your violation of these Terms, or your violation of any third-party right or applicable law.
13.Termination
We may suspend or terminate your access to the Site or any Service, in whole or in part, at any time and for any reason, including for violation of these Terms, with or without notice. Upon termination, the rights granted to you under these Terms will end, but the provisions that by their nature should survive will continue, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
14.Governing Law and Venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms, the Site, or the Services that is not subject to arbitration under Section 15 will be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
15.Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
Most disputes can be resolved informally. Before filing a formal claim, you agree to first contact us at support@buildthedamnthing.com and try to resolve the dispute in good faith for at least thirty (30) days.
If we cannot resolve a dispute informally, you and Genius Guild agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will take place in Delaware or, at your election, in your home state. Judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. You and Genius Guild agree that disputes will be resolved on an individual basis only. Neither party may bring or participate in a class, collective, or representative action.
This arbitration provision does not prevent either party from seeking injunctive or equitable relief in court for intellectual property infringement or unauthorized access to the Site.
16.Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top. If the changes are material, we will provide additional notice, such as an email or a banner on the Site. Your continued use of the Site or the Services after the changes take effect means you accept the updated Terms.
17.Miscellaneous
These Terms, together with our Privacy Policy, are the entire agreement between you and Genius Guild regarding the Site and the Services. If any provision is held invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
